Terms & Conditions – Notey

1. Acceptance of Terms
By downloading, installing, or using Notey ("the Application"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please uninstall the Application immediately.
2. License
Notey grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly for your personal, non-commercial use on devices owned or controlled by you.
3. User Content & Backup Responsibility
Ownership
You retain full ownership of all notes, images, media, and data ("Content") created within the Application. Notey does not claim any ownership rights over your Content.
Storage
The Application stores your Content locally on your device or in your personal Google Drive account if synchronization is enabled. Notey does not operate cloud servers to store your notes.
Backup
You acknowledge that you are solely responsible for maintaining backups of your Content. Notey provides tools for local backups and cloud sync via Google Drive, but Notey is not liable for any loss, corruption, or deletion of data resulting from device failure, app malfunction, or user error (e.g., forgotten Vault passwords).
4. Google Drive Integration
- By enabling synchronization, you authorize the Application to access your Google Drive account solely for the purpose of creating, updating, and reading files in the Application's dedicated app data folder.
- Notey strictly adheres to the Google API Services User Data Policy, including the Limited Use requirements.
5. Premium Subscription & Features
- Freemium Model: Some features (e.g., Unlimited Media, Vault Access, Cloud Sync) may require a one-time purchase or subscription ("Premium").
- Purchases: All purchases are processed through the Google Play Store and are subject to Google's rigorous payment terms and refund policies.
- Refunds: Refund requests must be directed to Google Play Support within their specified refund window.
6. Biometric Vault Feature
The "Vault" feature uses your device's biometric system (fingerprint/face) for authentication.
Warning: If you lose access to your device's biometric credentials or forget your backup PIN/Password, Notey cannot recover your Vault data as we do not store encryption keys.
7. Third-Party Services
The Application may contain links to third-party services (e.g., Google Maps for location reminders) or display advertisements (via AdMob). Notey is not responsible for the content, privacy policies, or practices of any third-party services.
8. Prohibited Uses
You agree not to use the Application for:
- Any unlawful purpose.
- Distributing malware or viruses.
- Harassing, abusing, or harming another person.
- Reverse engineering, decompiling, or attempting to extract the source code of the Application.
9. Termination
We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
10. Disclaimer of Warranties
The Application is provided on an "AS IS" and "AS AVAILABLE" basis. Notey disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
In no event shall Notey, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
